These Terms of Service ("Terms") govern your access to and use of nilesavannah.com (the "Site") and any purchase you make from Nile Savannah Co. ("Nile Savannah," "we," "us," "our"). By using the Site or buying a product, you agree to these Terms.
1. The Site & Account
You may browse the Site without an account. If you create an account, you agree to provide accurate information and keep your password secure. You are responsible for activity under your account.
2. Products
All products are described as accurately as we can. Because each piece is hand-carved, slight variations in color, grain, finish, and dimension are inherent and expected. Photographs are representative of the form, not a guarantee of identical match.
We reserve the right to limit purchase quantities, refuse service, or discontinue products at any time.
3. Pricing & Payment
Prices are in U.S. dollars unless noted. We may change pricing at any time, but changes will not affect orders already placed. We accept major credit cards, Apple Pay, Shop Pay, and other methods listed at checkout. Payment is processed by Shopify Payments and Stripe — we do not store full card numbers.
If a piece is mis-priced due to an obvious error, we reserve the right to cancel and refund the order.
4. Order Acceptance
An order is an offer to buy. We confirm receipt by email, but acceptance happens only when we ship. We may cancel an order before shipping for any reason — fraud detection, stock issues, pricing error — and will refund any payment in full.
5. Shipping & Returns
Shipping, delivery times, returns, and damage claims are governed by our Shipping & Returns policy, which is incorporated into these Terms.
6. Intellectual Property
All content on the Site — text, photography, video, illustration, design, the Nile Savannah wordmark, and product names — is the property of Nile Savannah Co. or its licensors. You may not copy, reproduce, or use it commercially without written permission.
You may share images of the Site or products on social media for personal, non-commercial purposes, with attribution to @nilesavannahco.
7. User Content
If you submit content to us — reviews, photos, comments, emails, social posts tagging us — you grant Nile Savannah a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the brand. You retain ownership of your content.
Don't submit anything you don't own, anything illegal, or anything that infringes someone else's rights.
8. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to access systems, accounts, or data not intended for you
- Scrape, mirror, or systematically copy the Site
- Introduce malware, viruses, or other harmful code
- Harass our team, our customers, or our partner artisans
9. Disclaimers
The Site and products are provided "as is." We make no warranties beyond those required by law and our published policies. We do not guarantee uninterrupted access to the Site or error-free operation.
10. Limitation of Liability
To the fullest extent permitted by law, Nile Savannah's total liability arising out of or relating to your use of the Site or any product is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
Some jurisdictions do not allow limitations on certain damages — to that extent, this section does not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Nile Savannah Co., its officers, employees, and partners from any claim arising out of your breach of these Terms or your misuse of the Site.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute that cannot be resolved through good-faith negotiation will be resolved by binding arbitration in Hampden County, Massachusetts, under the rules of the American Arbitration Association — except that small-claims-court matters are exempt.
13. Changes to These Terms
We may update these Terms from time to time. The "Effective date" will reflect material changes. Continued use of the Site after changes constitutes acceptance.
